1. Acceptance of Terms

By accessing https://escalative.com or engaging Escalative for software development, web engineering, mobile applications, UI/UX design, or video editing services, you agree to be bound by these Terms of Service and all applicable laws.

2. Services & Project Engagements

Escalative provides full-lifecycle digital product services including custom web development, mobile applications, software engineering, AI solutions, UI/UX design, branding, and video editing.

Specific deliverables, timelines, milestone schedules, and fees for any project are defined in the mutually approved Statement of Work (SOW), formal proposal, or service agreement.

3. Intellectual Property Rights

Client Deliverables: Upon full payment of all agreed project fees, all bespoke code, design tokens, graphic collateral, videos, and deliverables created specifically for you become your exclusive intellectual property.

Escalative Pre-existing Assets: Any open-source libraries, general frameworks, pre-existing proprietary tools, or boilerplates used to construct the solution remain the property of their respective holders, licensed to you under standard commercial or open-source licenses.

4. Payment Terms & Invoicing

Payments are structured according to agreed project milestones (e.g., upfront discovery deposit, milestone delivery payments, and final deployment balance).

Invoices are payable digitally via wire transfer, bank payment, or approved payment gateways within the timeline specified on the invoice.

5. Client Responsibilities

To ensure timely delivery, clients agree to provide necessary assets, access credentials, feedback, and approvals within reasonable timeframes discussed during kickoff.

6. Limitation of Liability

Escalative delivers all software and services with rigorous quality standards and industry-standard testing. In no event shall Escalative be liable for indirect, incidental, consequential, or punitive damages arising from the use or inability to use the delivered products beyond the total fees paid under the specific engagement.

7. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the competent courts in India.
